Terms of Service

These terms are an agreement between KinderFill and the childcare business ("you") that creates an account. By using KinderFill you accept them.

1. The service

KinderFill provides enrollment software — lead capture, tour booking, messaging, AI-assisted drafting, and reporting — and, for customers on a Managed plan, a done-for-you service in which our team operates marketing campaigns on your behalf using that software. Managed work is performed with your authorization, on ad and social accounts you own or have authorized us to use, and material actions are recorded in your account's audit history.

2. Your responsibilities

You agree to use KinderFill only to operate a childcare business you are authorized to manage, and to comply with the laws that apply to you — including TCPA and CASL messaging-consent rules, COPPA-adjacent obligations, and your state or provincial childcare regulations. In particular, you must have appropriate consent before any automated message is sent to a family. KinderFill enforces consent capture and opt-out handling in the product, but you are responsible for the truthfulness of your marketing content and your conduct with families.

3. Your data

You own the data you and your leads put into KinderFill. You can export it at any time and request deletion of your account and data (see our Privacy Policy). We retain a minimal audit log of system-of-record events for legal and security purposes. We never sell your data or share it with other customers.

4. AI features

KinderFill includes AI features that score leads, draft messages, and summarize activity. AI drafts addressed to families require human approval before sending. AI output can be imperfect; you are responsible for reviewing anything you approve or publish.

5. Fees & billing

Software subscriptions are billed monthly per location through Stripe. Managed-service retainers are billed as agreed in your engagement. Ad spend is paid by you directly to the ad platforms and is never a KinderFill fee. You can cancel at any time from your billing page; access continues through the end of the current billing period. Prices may change with at least 30 days' notice, effective at your next renewal.

6. 90-day money-back guarantee

If, within the first 90 days of a new paid subscription, you decide KinderFill isn't earning its keep, contact support (reply to any billing email or write to support@kinderfill.com) before day 90 to request a refund. We will refund the KinderFill subscription fees billed during that 90-day window. The guarantee covers the KinderFill software fee only — not ad spend paid to Meta, Google, or any other platform, third-party setup costs, or the Managed service retainer — and applies once per organization, to its first paid subscription.

7. Acceptable use

You may not use KinderFill to send spam or messages without required consent, to upload unlawful content, to attempt to access another customer's data, or to resell the service without our written agreement. We may suspend accounts that put families, other customers, or the platform at risk, and we will tell you why.

8. Disclaimers & liability

The service is provided "as is" while in early access. We work hard on uptime and data durability but do not guarantee a specific SLA at this stage, and we do not guarantee marketing outcomes such as a number of leads, tours, or enrollments. To the maximum extent permitted by law, KinderFill's total liability for any claim is limited to the fees you paid us in the 3 months before the event giving rise to the claim, and neither party is liable for indirect or consequential damages.

9. Termination

You can close your account at any time. We may terminate for material breach of these terms if the breach is not cured within 14 days of notice. On closure, the export and deletion commitments in §3 apply.

10. Changes & contact

If we materially change these terms we will notify you by email at least 14 days before the change takes effect; continued use after that constitutes acceptance. Questions: support@kinderfill.com.
